Age Discrimination

How old must an employee be to qualify for protection under the ADEA?

The ADEA only provides protections to employees who are at least 40 years of age. This means that if an employer fires a 38-year-old employee and replaces him with a 18-year-old employee, the employer has not violated the ADEA.
