The Fuller Court’s controversial decision in Pollock v. Farmers’ Loan & Trust Co. (1895), striking down most of an 1894 federal income tax law, led to the eventual passage of the Sixteenth Amendment in 1913, which provides: “The Congress shall have power to lay and collect taxes on incomes, from whatever source derived, without apportionment among the several States and without regard to any census or enumeration.”
