One of Milligan’s attorneys before the U.S. Supreme Court was prominent New York–based practitioner David Dudley Field, the brother of U.S. Supreme Court justice Stephen Field. Judicial ethics were not as rigid as they are today, so there was little talk of Justice Field recusing himself.
