At first, President Hoover did not want to nominate well-known New York judge Benjamin Cardozo for reasons based on religion and geography. First, he believed that the Supreme Court did not need another Jewish justice, as Justice Louis Brandeis already served on the Court. Second, Hoover believed that there should not be a third justice from the state of New York, as Chief Justice Charles Evans Hughes and Justice Harlan Fiske Stone were already from that state. Hoover eventually relented, in part because Justice Stone offered his resignation if the president nominated Cardozo.
